FREDD HAAS: Truck driver negligence and error involves common activities like speeding, not paying attention, talking on the cell phone. It can also involve perhaps a situation where the truck driver has a pet inside the truck and is paying attention to the pet.
The most important thing to remember in looking at truck driver error or negligence is why was that truck driver negligent. There's a root cause that has to be discovered. Was the truck driver speeding because he was given a time to have the load at a certain place? And, to get there at that time, he had to speed. Another example might be he was sleeping. Why was he sleeping? He may have been out too late the night before and he knew that the load at to be at a place at a certain time. So, he was going to leave at the same time anyway. And, he didn't have the appropriate amount of sleep. Not a lot of times, but you can have alcohol involved, use of drugs, either prescription or illicit drugs that influence driver activity. So, in all of these cases the primary focus has to be why did the truck driver do what he or she did.
