Victims of trucking accidents should seek compensation for all of their losses.
FREDD HAAS: Following a trucking accident, if it doesn't involve a death, you want to seek compensation for all of your losses. The most immediate loss usually is medical expenses. So, keep a good record of all of your medical expenses.
The second loss usually is loss of income or wage. So, you want to make sure that you keep an accurate record of your time lost from work. Important in determining time lost from work is make sure you have a doctor who is recommending you either work or not work. It is a lot easier to prove wage loss if you have a doctor's record saying you can't work or you can work part-time.
A third item of loss or compensation would be for pain and suffering. Pain and suffering includes not only the physical loss or suffering, it also includes the mental or emotional loss or suffering and it can include loss of enjoyment of life; the loss of the ability to play with your children and so forth.
And, finally, if you end up with some type of permanent loss, whether that be loss of a limb or loss of the function of a limb, you can seek recovery for that as well.
Values are determined upon the extent of loss. What we do, in our office, is help you put together each and every item of loss and then, place a value on that loss. And then, that's what we ask the jury to compensate you for.
