FREDD HAAS: Immediately after the accident you need to make sure that there's someone that is involved right away investigating the scene. And, the reason for that is simple. Law enforcement officers are only going to get some of the facts. They're not going to get all of the facts. So, you need someone out there investigating the accident from your perspective.

The trucking company is going to have someone there early investigating the accident from their perspective. You want to make sure that someone quickly gets to the scene, accurately documents the scene and records, if they can, what occurred. After that, you need to take steps to make sure that the evidence that has been gathered is preserved.

We have a standard letter that we send out right away to the other side and their insurance carrier requesting them to retain over 30 items that we've identified could exist in any trucking accident. Once that's done, then you need to investigate who was involved in this accident. You need to identify all of the active players, whether it's the driver, the dispatcher, the broker, the company and so forth.

After you get all of that information, in most of these cases, the next thing you do is file the lawsuit. And, the reason for that is simple. You're going to be in for a fight. And, the earlier you get started preparing for the fight, the better.
