FREDD HAAS: Companies are required by the Federal Motor Carrier Regulations to hire a qualified driver. There are specific rules as to what they need to do to make sure they put a qualified driver in their truck. We need to look at their files to see if the driver was qualified to be driving the truck. Once they hire the driver, then we need to make sure that that person maintains his or her qualifications. So, we need to look into whether or not they have had some violations that should have required the company to remove them from the truck. Then, we also need to make sure that the company has policies which they enforce making sure their drivers drive safely.

So, as it relates to company liability, there is a relationship there between them and their drivers that starts at the beginning and goes all the way through the driving activity. That's important. Oftentimes that plays a part in whether or not an accident occurred.
