FREDD HAAS: There are specific regulations in the Federal Motor Carrier Regulations with regard to the loading of trucks, specifically the loading of trailers. In addition, there are industry standards with regard to the loading and unloading of trucks. What is most important in cases is who loaded the truck; was the truck properly loaded; and then, when you're investigating accident, you look to see if the loading of the truck played a part in the ultimate collision.
An example would be, let's say you have a one vehicle accident where the truck goes off the road. Did the truck go off the road because the driver fell asleep? Or, did the truck go off the road because the load inside the trailer shifted causing the truck operator to lose control of the vehicle?
Another common situation that you run into is an improperly loaded trailer, especially flatbeds, where items are not tied down or secured properly. And then, as the driver goes down the road, literally, products are flying off the back end of the truck. In those particular cases, you can have a situation where there's serious injury or death because of improper loading.
