FREDD HAAS: Trucks speeding involves, of course, a driver driving the vehicle at a speed that either exceeds the posted limit, or perhaps exceeds what would be reasonable given the elements that exist. In certain situations, for example bad weather, you need to drive the truck at a speed that allows you to drive the truck safely, in terms of stopping, in terms of keeping the truck on the road and so forth. So, each case can be judged differently.
If the truck is loaded and overloaded, there may be a safer speed than the posted speed limit. One thing to keep in mind about truck speed, in a lot of trucks today there are instruments which measure the speed of the truck. So, a lot of times you don't find out the true speed until you get a hold of this particular data, which is available.
One thing that I've learned is that most people, if you ask them what their speed was, they don't give you an accurate recording of what their speed is. And, when you get involved in a case then there may not be any evidence in the accident report that there was speeding. So, you may have to look beyond the accident report to find out whether speeding was involved and that was a cause of the accident.
