FREDD HAAS: Premises liability cases involve cases wherein someone is injured as a result of a defective condition on the property. Defective conditions on the property can be unsafe steps, inadequate lighting, raised boards which cause tripping hazards. Anything that makes the property unsafe can fit into the classification of a premises liability case.
Business owners, or individuals, are required to keep their property in a reasonably safe condition. The focus then is on what was the condition and how did that condition play a part in your injury. The most important thing for you to do is to document the condition which you believe is unsafe. You can document that by either taking a picture or a videotape and then, if you can, try to determine how long that condition had existed. So, we can then show that the owner of the property knew of the unsafe condition.
