FREDD HAAS: Slip and fall accidents can involve trips, slips on water on the floor, slips on ice and so forth. In all of those cases, the most important thing for an individual to do is to document the condition. And, by that I mean get a picture of the area where you fell as soon as you can. If you can get a videotape of that condition, do so. And, the reason for that is you have to be able to prove that the condition posed an unreasonably dangerous situation. Most times you don't have an individual who has an accurate recall of what it was that they tripped over or slipped on. So, you need to get someone there to document the condition.
Once the condition is documented, then you need to try to figure out how long that condition existed. And, the reason for that is you have to be able to establish that the owner of the property knew or should have known of the dangerous condition.
Pay special attention to who shows up at the scene. Make sure you write down the names of anyone who was at the scene, whether it be other individuals or store employees, for example. All of those people will have knowledge as to why the condition existed, how long it existed and whether or not it was dangerous. If you do that, you'll have a chance of proving a case.
