FREDD HAAS: Nursing home injuries can involve a lot of different situations. Common situations we see are the patient developed a bed ulcer or the patient slipped and fell or the patient fell out of bed or the patient got a hold of medication that they shouldn't have received. In all of those cases, what has happened is there has been a lack of follow through by the caretaker in terms of providing care to the patient.
There are specific regulations which govern how nursing homes should be run. We spend a great deal of time reviewing the nursing home records, reviewing the nursing home history to see if they've had prior complaints or prior problems. It's usually in situations where there have been prior complaints and prior problems where other events occur. Once you determine that there is a history there, then you have a good chance of proving your case.
