FREDD HAAS: Birth injury cases are sad events that are very complicated to prove. Most people hope and believe that their child is going to be born and be born without any problems. Occasionally, a child is born and there's severe disability or death. It is in those cases that we oftentimes get asked to evaluate the medical treatment that was received to see if the medical treatment played a part, or was the cause, of the child's disability or death.
What we do initially is get a detailed account of the birth process from the mother and father. After that, we make sure we get a complete copy of all of the child's medical records and the mother's records, both with regard to birth and any prenatal care they received.
Once that is obtained, the next step is to have those records reviewed by medical experts. Birth injury cases involve not only an obstetrician, oftentimes, it involves pediatricians. It may also involve someone who has a specialty in genetics; someone who has a specialty in infections.
In summary, these cases are cases that involve a great deal of medical knowledge and a willingness, and a desire, to work with medical experts to put the case together.
